The following legally described trust property will be sold by Ryan C. Hengl, Esq., Attorney at Law and Successor Trustee, pursuant to the power of sale under that certain Deed of Trust recorded on September 23, 2008, at Book 4623, Page 327 and that certain Assignment of Deed of Trust recorded August 1, 2012, at Book 4896, Page 668, in the office of the County Recorder of Yavapai County, Arizona at public auction to the highest bidder, in on the steps of the Yavapai County Superior Court, located at 120 S. Cortez Street, Prescott, Arizona, 86303, on January 18, 2013, at 10:00 A.M. on said day. Said sale shall be made for cash, but without covenant or warranty, express or implied, regarding title, possession or encumbrances, to pay the remaining sum of the note(s) secured by said Deed of Trust, namely the balance of $39,300.00 with interest thereon as provided in said note(s), advances if any, under the terms of said Deed of Trust, interest on advances, if any, fees, charges and expenses of the Deed of Trust and the Trust created by said Deed of Trust. Trustee will accept only cash or cashier's check/cash equivalent (in lawful money of the United States) for reinstatement or price bid payment. Reinstatement payment must be paid before five o'clock P.M. (5:00 P.M.) on the last day other than a Saturday or legal holiday before the date of the sale. The purchaser at the sale, other than the Beneficiary to the extent of its credit bid, shall pay the price bid no later than five o'clock P.M. (5:00 P.M.) of the following day, other than a Saturday or legal holiday. If the Trustee is unable to convey title for any reason, the successful bidder's sole and exclusive remedy shall be the return of monies paid to the Trustee, and the successful bidder shall have no further recourse.
